SwarmTix is committed to protecting your personal information, and we respect your privacy. This Privacy Policy explains how we use and protect the personal information we collect when you attempt to or actually do order a ticket using our Website or Website Services. This Policy applies to all users of SwarmTix.com (the “Website”) and the SwarmTix services (the “Website Services”).

By using the Website, you are accepting the terms of this policy and agree that they are adequate and sufficient to protect your privacy.

1. Who We Are
Welcome to SwarmTix! We are an e-ticketing platform dedicated to make your life easier and bring people together through different life experiences. Through our platform, services and mobile apps you can create, register, share and discover events. SwarmTix, Inc. is a Delaware corporation with its principal place of business at 2035 Sunset Lake Road, Suite B-2, in the city of Newark, zip code 19702 (“Swarmtix,” “us,” “we” or “our”). 2. Users
Through our platform, SwarmTix helps event organizers, planners and charitable organizations (“Hosts”) who are registered users to create quickly and easily different events or fundraisings and simple. We refer to Hosts, Attendees and other visitors and browsers of the Services collectively as “Users” or “you.”

3. Collecting Your Personal Information
SwarmTix may collect personal information from you such as your name, phone number, and email address, on behalf of our clients (the “Hosts”). When you buy or attempt to buy a ticket from a Host using the Website and the Website Services, SwarmTix collects additional information on behalf of the Hosts, including, without limitation, financial information from you (credit card data, billing address, etc.). These are called personal information or personally identifiable information, such as your name, address, e-mail address, credit card information, birth date, gender, etc.) you also provide non-personal information which is an information of an anonymous nature. Such non-personal information is the domain used to access the Website, the date and time you access the site, and the type and version of browser or operating system being used by visitors to the Website. In other words, your activities on the Website.

4. Data Protection
SwarmTix has security measures in place to help safeguard your information from unauthorized access or disclosure. Only SwarmTix employees are permitted to access your personal information. We also encrypt all credit card data before it is sent from your computer through the Internet Gateway. SwarmTix does not store any credit card data except for last 4 digits of the card, and this is available only so that the Host can ensure the buyer’s identity in the case that a ticket is lost or misplaced. We take precautions to ensure the security of your personal information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your personal information despite our efforts. In using the Website, your information will travel through third party infrastructures which are not under our control.

5. Use of Information
SwarmTix may use information that we collect about you in one or more of the following ways, among others:
• Processing the payment for tickets you purchase;
• Delivering tickets, products and services made on the Website;
• To communicate with you by e-mail, telephone and/or mobile devices about events and tickets you purchase;
• To include you in Hosts mailing lists in which you choose to participate;
• To better protect you from or identify fraudulent transactions;
• To enforce our terms and conditions.

6. Other Websites/Third Parties
Third parties have their own privacy policies that govern their use of your information. There are a number of places on the Website where you may click on a link to access other websites that don’t operate under this Privacy Policy. For example, if you click on a link on the Website from an event to the performer’s own website, you may be taken to a website that we don’t control. These third-party websites may independently solicit and collect information, including personal information, from you. It’s the same if you click on an advertisement on the Website. Importantly, these third parties will have their own privacy policies describing how they use and disclose your personal information. Those policies will govern the use, handling and disclosure of your personal information once you or we have shared it with those third parties. If you want to learn more about other entities’ privacy practices, please review the websites of those third parties. Privacy policies are typically located at the bottom of the web page you are visiting. At no time does SwarmTix use your personal information to send commercial or promotional emails. In the case that a commercial or promotional email is sent to you from the Host where you purchased tickets, you should consult with the Host to opt out of receiving such messages.

7. Disclosures & Transfers
We have put in place contractual and other organizational safseguards with our agents to ensure a proper level of protection of your Personal Information. In addition to those measures, we will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Policy (see Important Exceptions below). As at the date of this Privacy Policy, we share Personal Information about you in respect of the Website only with the service providers listed below and accordingly your Personal Information may be available to Canadian and United States government or agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information. Some of our business partners include:

• System integrators.

From time to time we may employ third parties to help us improve the Website and/or the Services. These third parties may have limited access to databases of user information solely for the purpose of helping us to improve the Website and/or the Services and they will be subject to contractual restrictions prohibiting them from using the information about our members for any other purpose.

We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Website members, other users of the Services, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law. We may also disclose your Personal Information in connection with a corporate re-organization, a merger or amalgamation with another entity, a sale of all or a substantial portion of our assets or stock, including any due diligence exercise carried out in relation to the same, provided that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring the information.

By using the Website, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use the Website. The Website is not intended for children under 13, and we do not knowingly collect information from children under the age of 13. Children aged 13 or older should not submit any personal information without the permission of their parents or guardians.

9. Visiting Our Website from Outside the United States
This Privacy Policy covers the collection of information on the Website from U.S. and Canadian residents. If you are visiting the Website from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. U.S. data protection and other laws may not be as comprehensive as those in your country. Please be assured that we take steps to ensure that your privacy is protected.

10. Changes to This Privacy Policy
We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the “Updated at” date at the top of this page. If we make any changes in the way we collect, use, and/or share your personal information, we will notify you by displaying a notice of the changes on our website. We recommend that you check the Website periodically to be aware of any changes in our privacy or other policies.

11. UK, EEA AND SWITZERLAND ONLY
The EU General Data Protection Regulation (GDPR)
Since May 2018, a new data privacy law known as the EU General Data Protection Regulation (or the "GDPR") becomes effective. This regulation requires SwarmTix and Hosts using the Service to provide Users with more information about the processing of their Personal Data.
This is everything you need to know about this law:

a) Legal grounds for processing your Personal Data
According to the GDPR, we are required to tell you about the legal ground we're relying on to process any Personal Data about you.
Normally, the legal grounds for us processing your Personal Data will be because of several different things:
- it is necessary for our contractual relationship;
- the processing is necessary for us to comply with our legal or regulatory obligations; and/or
- the processing is in our legitimate interest as an event organizing and ticketing platform (for example, to protect the security and integrity of our systems and to provide you with customer service, etc.);
- you provided your consent.

b) Transfers of Personal Data
Since SwarmTix is a company on a global level, sometimes, we may need to transfer your Personal Data outside of the country from which it was originally provided. This may be third parties or to intra-group that we work with who may be located in jurisdictions outside the UK, the EEA and Switzerland which have no data protection laws or laws that are less strict in comparison to those in Europe. In order to protect your Personal Data when we transfer them outside of the UK, the EEA or Switzerland, we take legally required steps to make sure that appropriate safeguards are in place.

c) Personal Data retention
In order to provide you with our Services, we retain your Personal Data for as long as necessary. Also, we can do that for other important purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements. Normally, if you have an account with us, we will retain your Personal Data for a period of 90 days after you have requested that your account is closed or if it's been inactive for 10 years.

d) Your rights
Data protection law provides you with rights in respect of Personal Data that we hold about you, including the right to request a copy of the Personal Data, request that we rectify, restrict or delete your Personal Data, object to profiling and unsubscribe from marketing communications.
For the most part, you can exercise your rights in respect of Personal Data by logging in and visiting the Settings -> User profile page or changing the "cookie settings" in your browser. If you can't find what you're looking for there, you can contact us using the contact information. Please note that requests to exercise data protection rights will be assessed by us on a case-by-case basis. There may be circumstances where we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided for in data protection legislation.
If you have a complaint about how we handle your Personal Data, please get in touch with us so that we can explain. If you are not happy with how we have attempted to resolve your complaint, you may contact the relevant data protection authority.

e) SwarmTix as a data processor and a data controller
EU data protection law makes a distinction between organizations that process personal data on behalf of other organizations (known as "data processors") and organizations that process Personal Data for their own purposes (known as "data controllers"). If you have a question or complaint about how your Personal Data is handled, these should always be directed to the relevant data controller since they are the ones with primary responsibility for your Personal Data.

Depending on the circumstances, SwarmTix may act as either a data controller or a data processor in respect of your Personal Data. For example, if you create an account with us to organize your events, SwarmTix will be a data controller in respect of the Personal Data that you provide as part of your account. We will also be a data controller of the Personal Data that we have obtained about the use of the Applications, which could relate to Hosts or Attendees. We use this to conduct research and analysis to help better understand and serve Users of the Services as well as to improve our platform and provide you with more targeted and personalized recommendations about events we think may be of interest to you.
However, if you register for an event as an Attendee, we will process your Personal Data to help administer that event on behalf of the Host (for example, sending confirmation, promotional and feedback emails, processing payments, etc.) and to help the Host target, and understand the success of, their event and event planning (for example, providing event reports, using analytics to gain insights into the effectiveness of various sales channels, etc.). In these circumstances, SwarmTix merely provides the "tools" for Hosts; SwarmTix does not decide what Personal Data to request on registration forms, nor is it responsible for the continued accuracy any Personal Data provided. Any questions that you may have relating to your Personal Data and your rights under data protection law should therefore be directed to the Host as the data controller, not to SwarmTix.
